National Bank of Canada <\/em><\/a>states the principle that the plaintiff bears the onus of establishing the inappropriateness of a proceeding as part of a discovery argument:<\/p>\n<blockquote><p>[<a class=\"paragAnchor\" name=\"par13\"><\/a>13]\u00a0\u00a0 \u00a0\u00a0\u00a0We agree with the appellant that it was the respondent who bore the onus of leading evidence to\u00a0establish on a balance\u00a0of probabilities that a proceeding was not appropriate in 2010 (see:\u00a0<em>Miaskowski (Litigation guardian of) v. Deol<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2016\/2016onca249\/2016onca249.html\"><span class=\"reflex3-alt\">2016 ONCA 249<\/span>\u00a0(CanLII)<\/a>\u00a0at para16<\/span>; and\u00a0<em>Galota v.
