Non-Marine Underwriters, Lloyd&#8217;s of London<\/em><\/a>:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\">[<a class=\"paragAnchor\" name=\"par13\"><\/a>13]\u00a0\u00a0 \u00a0\u00a0\u00a0The second is to submit that the appeal against the other defendants, if successful, might have eliminated their losses and thus the appellants did not know that this action was \u201can appropriate means\u201d to seek to remedy its losses until the appeal was dismissed, relying on\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec5subsec1_smooth\">s. 5(1)<\/a>(a)(iv) of the\u00a0<em><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a><\/em><i>\u00a0<\/i>and\u00a0<em>Presidential MSH Corp. v. Marr, Foster &amp; Co. LLP<\/em><i>\u00a0<\/i><span class=\"reflex3-block\">(2017),\u00a0<span class=\"reflex3-alt\">135 O.R. (3d) 321<\/span>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2017\/2017onca325\/2017onca325.html\"><span class=\"reflex3-alt\">2017 ONCA 325 (CanLII)<\/span><\/a><\/span>. In our view,\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec5subsec1_smooth\">s. 5(1)<\/a>(a)(iv) is not intended to be used to parse claims as between different defendants and thus permit one defendant to be pursued before turning to another defendant. Rather, it is intended to address the situation where there may be an avenue of relief outside of a court proceeding that a party can use to remedy their \u201cinjury, loss or damage\u201d \u2013 see, for example,\u00a0<em>407 ETR Concession Co. v. Day<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2016\/2016onca709\/2016onca709.html\"><span class=\"reflex3-alt\">2016 ONCA 709<\/span>\u00a0(CanLII)<\/a>,\u00a0<span class=\"reflex3-alt\">133 O.R. (3d) 762<\/span><\/span>.<\/p>\n<\/blockquote>\n<p>The Court also included a reminder that seeking a declaration in addition to consequential relief will not avoid a limitations defence by engaging s. 16(1)(a) of the Limitations Act:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\">[<a class=\"paragAnchor\" name=\"par14\"><\/a>14]\u00a0\u00a0 \u00a0\u00a0\u00a0The third is the argument that the appellants only sought declaratory relief and therefore, under\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec16subsec1_smooth\">s. 16(1)<\/a>(a) of the\u00a0<em><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a><\/em>, the two year limitation period does not apply. That argument cannot succeed because the claim in this action was not limited to declaratory relief. The claim also sought consequential relief, namely damages, so\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec16subsec1_smooth\">s. 16(1)<\/a>(a) does not apply.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>When the success of an appeal in a related but separate proceeding (involving the same defendants) will eliminate damage, is a proceeding to remedy that damage inappropriate until the appeal&#8217;s determination?\u00a0 No, held the Court of Appeal in Tapak v.
