{"id":646,"date":"2018-01-17T14:56:15","date_gmt":"2018-01-17T18:56:15","guid":{"rendered":"http:\/\/limitations.ca\/?p=646"},"modified":"2018-01-17T14:56:15","modified_gmt":"2018-01-17T18:56:15","slug":"ontario-remember-the-amendment-principles","status":"publish","type":"post","link":"https:\/\/limitations.ca\/?p=646","title":{"rendered":"Ontario: remember the amendment principles"},"content":{"rendered":"<p>Master Muir provides a helpful summary of amendment principles in <a href=\"http:\/\/canlii.ca\/t\/hnqr6\" target=\"_blank\"><em>Concord Adex Inc. v. 20\/20 Management Limited<\/em><\/a>:<\/p>\n<blockquote>\n<p class=\"Mainparagraph\">[<a class=\"paragAnchor\" name=\"par20\"><\/a>20]\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0The law in relation to motions seeking leave to amend a pleading is well settled and was not seriously in dispute on this motion. The applicable principles are summarized in my decision in\u00a0<i>Greenwald v. Ridgevale Inc.<\/i>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2016\/2016onsc3031\/2016onsc3031.html\">2016 ONSC 3031 (CanLII)<\/a>,\u00a0<span class=\"reflex3-alt\">2016 ONSC 3031 (Master)<\/span><\/span>. At paragraph 21 of\u00a0<i>Greenwald<\/i>\u00a0I set out those factors as follows:<\/p>\n<p class=\"Mainparagraph\">\u2022 the amendments must not result in prejudice;<\/p>\n<p class=\"Mainparagraph\">\u2022 the amendments must be legally tenable;<\/p>\n<p class=\"Mainparagraph\">\u2022 the amendments must comply with the rules of pleading;<\/p>\n<p class=\"Mainparagraph\">\u2022 a motion to add a party must meet all of the requirements of a motion under\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/regu\/rro-1990-reg-194\/latest\/rro-1990-reg-194.html#sec26.01_smooth\">Rule 26.01<\/a>;<\/p>\n<p class=\"Mainparagraph\">\u2022 the addition of the party should relate to the same transaction or occurrence;<\/p>\n<p class=\"Mainparagraph\">\u2022 the addition of the party should not unduly delay or complicate the hearing;<\/p>\n<p class=\"Mainparagraph\">\u2022 the addition of a party will not be permitted if it is shown to be an abuse of process.<\/p>\n<\/blockquote>\n<p>It is useful to keep these in mind when considering whether a motion to add a party of the presumptive expiry of the limitation period.<\/p>\n<p>There is also a reminder that standard of discovery applicable when determining whether to add a proposed defendant after the presumptive expiry of the limitation period is reasonable discovery, not possible discovery:<\/p>\n<blockquote>\n<p class=\"Mainparagraph\">[<a class=\"paragAnchor\" name=\"par47\"><\/a>47]\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0With respect to all of these arguments it is important to emphasize that it is reasonable discoverability and not the mere possibility of discovery that triggers a limitation period. See\u00a0<i>Crombie Property Holdings Ltd. v. McColl-Frontenac Inc.<\/i>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2017\/2017onca16\/2017onca16.html\"><span class=\"reflex3-alt\">2017 ONCA 16<\/span>\u00a0(CanLII)<\/a>\u00a0at paragraph 35<\/span>; leave to appeal refused, 2017 SCCA No. 85. The proposed defendants appear to be holding the plaintiffs to a standard of perfection.
