Equifax Canada Co<\/em><\/a>\u00a0advanced a quite clever, but entirely incorrect argument that the\u00a0<a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24\">Limitations Act<\/a>\u00a0applies to the\u00a0<em>Consumer Reporting Act<\/em>, which we wrote about\u00a0<a href=\"http:\/\/limitations.ca\/?p=363\">here<\/a>.<\/p>\n<p>The Court of Appeal upheld the motion judge\u2019s decision rejecting the\u00a0argument:<\/p>\n<blockquote><p>[5]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 The CRA provides for a regulatory scheme for the fair reporting of information regarding an individual\u2019s history of credit activities. The CRA requires the registration of consumer reporting agencies, permits consumer reporting information to be provided only for certain prescribed purposes, and sets out standards for consumer reporting.<\/p>\n<p>[6]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 The\u00a0<em><a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a>,<\/em><em>\u00a0<\/em>by contrast, applies to bar \u201cclaims pursued in court proceedings\u201d that are commenced outside the applicable limitation period. The Act does not apply to the\u00a0<a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-c33\/latest\/rso-1990-c-c33.html\">CRA<\/a>, whether expressly or by implication. Indeed, the\u00a0<a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-c33\/latest\/rso-1990-c-c33.html\">CRA<\/a>\u00a0contains its own specific provisions prohibiting the inclusion of certain information in consumer reports, including debts or collections more than seven years old, unless confirmation that the debt or collection is not barred has been obtained. The CRA expressly contemplates that debts not reduced to judgment that are up to seven years old may be reported (see\u00a0<a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-c33\/latest\/rso-1990-c-c33.html#sec9subsec3_smooth\">s. 9(3)<\/a>(f)). This makes sense, as the passing of a limitation period does not extinguish a debt; it only precludes the commencement of a court proceeding for its enforcement. As such, the reporting of debts after a limitation period has passed, is not inconsistent with the purposes of the\u00a0<a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-c33\/latest\/rso-1990-c-c33.html\">CRA<\/a>, and is expressly contemplated by its terms.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The plaintiff in\u00a0Grant v.
