Canjam Trading Ltd<\/em><\/a> is of interest because it relies on the practically ancient (at least in terms of limitations jurisprudence) decision in <a href=\"http:\/\/canlii.ca\/t\/1p6zq\" target=\"_blank\"><em>Consumers Glass Co. v. Foundation Co. of Canada Ltd<\/em><\/a> (1985) for the principle that \u201cmere knowledge of a possible claim is not sufficient to trigger the commencement of time for limitation purposes.\u201d<\/p>\n<p>This principle has been codified in <a href=\"http:\/\/www.e-laws.gov.on.ca\/html\/statutes\/english\/elaws_statutes_02l24_e.htm#BK6\" target=\"_blank\">section 5(1)(a)<\/a> of the <a href=\"http:\/\/www.e-laws.gov.on.ca\/html\/statutes\/english\/elaws_statutes_02l24_e.htm\" target=\"_blank\"><em>Limitations Act, 2002 <\/em><\/a>since January 2004. Nevertheless, it\u2019s good that the Court is emphasising the point, even if by relying on dusty, albeit still frequently-cited authority. It remains frustratingly difficult for many who practiced under the old Act to accept that the limitation period doesn\u2019t necessarily commence on the date of the loss.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>AIG Insurance Co. v.
