Spirit Financial Inc.<\/em><\/a> includes the following paragraph that compels me to pedantry:<\/p>\n<blockquote><p>[<a class=\"reflex-paragAnchor\" name=\"par14\"><\/a>14]\u00a0\u00a0 \u00a0\u00a0\u00a0The trial judge made a finding of fact that all the advances made by Michel to Kramer and Spirit were loans. The loans were advanced from 2000 to 2009, during which time the\u00a0<em>Limitations Act<\/em><em>,\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\">R.S.O. 1990, c. L.15<\/a>\u00a0was largely replaced by the\u00a0<\/em><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\"><em>Limitations Act, 2002<\/em><em>, S.O. 2002, c. 24, Sched. B<\/em><\/a>. On January 1, 2004 the basic limitation period for demand loans was changed from six years from the date of the loan to two years from the date of the demand:\u00a0<em>Hare v. Hare<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2006\/2006canlii41650\/2006canlii41650.html\">2006 CanLII 41650 (ON CA)<\/a>,\u00a0<span class=\"reflex3-alt\">83 O.R. (3d) 766 (C.A.)<\/span>, at para.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2006\/2006canlii41650\/2006canlii41650.html#par11\">11<\/a><\/span>\u00a0and\u00a0<em><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a><\/em>, at\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec5_smooth\">s. 5<\/a>.<\/p><\/blockquote>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\">\n<p>Here are the issues:<\/p>\n<\/div>\n<ol>\n<li>The Limitations Act didn&#8217;t change the limitation of demand loans when it came into force on January 1, 2004. Section 5(3) wasn\u2019t present in the initial version of the Limitations Act, which didn\u2019t address the discovery of a claim arising from demand obligations at all.The Court cites <em>Hare<\/em>, but <em>Hare <\/em>actually holds that, under the version of the Limitations Act in force when it was decided, a demand obligation was actionable as of the funds being advanced and not the date of the demand.\u00a0 This was manageable under the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90l15\/v1\" target=\"_blank\">Former Act<\/a>, which applied a six-year limitation period, but it&#8217;s problematic with\u00a0a two-year limitation period.\u00a0 This caused the Legislature to amend the Limitations Act in 2008 to add <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24#BK6\" target=\"_blank\">s. 5(3)<\/a>, which makes presumptive discovery of a claim arising from a demand loan the date of the demand for repayment.\n<p>Frankly, it\u2019s surprising that the Court would misstate the development of the law so materially.<\/li>\n<\/ol>\n<ol start=\"2\">\n<li>It\u2019s misleading to say that the Limitations Act \u201clargely\u201d replaced the Former Act. The Limitations Act and the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90l15\" target=\"_blank\">RPLA<\/a> together entirely replaced the Former Act.\u00a0 To be fair, the RPLA is Part I of the Former Act repackaged, and in that sense the Limitations Act only partially replaced the Former Act.\u00a0 Nevertheless, this statement suggests that some part of the Former Act remains in force.\u00a0 It doesn&#8217;t.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>The Court of Appeal decision in Michel v.
