Samis and Kozmik <\/em><\/a>provides the perhaps obvious answer.\u00a0 Different limitation periods apply based (at least presumptively) on the date of service of the statement of claim:<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">[32]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Pearce made it clear in one of her prayers of relief for contribution and indemnity as against the defendants is with respect to the 2009 action.\u00a0 In reading the words in \u201ctheir grammatical and ordinary sense harmoniously with the scheme of the\u00a0<a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Act<\/a>\u201d<a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2018\/2018onsc3663\/2018onsc3663.html?autocompleteStr=2018%20ONSC%203663&amp;autocompletePos=1#_ftn9\" name=\"_ftnref9\">[9]<\/a>,\u00a0<a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec18_smooth\">section 18<\/a>\u00a0of the\u00a0<a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Act<\/a>\u00a0indicates that service of claims for indemnity and contribution commences on the date of service of the claim \u201cwhich contribution and indemnity\u00a0<strong>is<\/strong>\u00a0sought\u201d. The claim of which contribution and indemnity as against the defendants with respect the 2009 action \u201cis sought\u201d in that action which was commenced on September 14, 2009.\u00a0 It is clear that the contribution and indemnity claims of Pearce as against the defendants in the 2009 action exceeds two years from September 14, 2009.\u00a0 Accordingly, the claim of Pearce against the defendants with respect to \u201cdamages of the plaintiff, Ruo Hang Liu, in court file #CV-09-386969 (Toronto)\u201d\u00a0<a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2018\/2018onsc3663\/2018onsc3663.html?autocompleteStr=2018%20ONSC%203663&amp;autocompletePos=1#_ftn10\" name=\"_ftnref10\">[10]<\/a>is barred by the\u00a0<a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Act<\/a>.<\/p>\n<\/blockquote>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>How does s. 18\u00a0of the Limitations Act apply when a party seeks contribution and indemnity in regards of claims pursued in separate proceedings commenced on different dates?\u00a0 The decision in Berwick v.
