{"id":759,"date":"2018-06-04T17:32:39","date_gmt":"2018-06-04T21:32:39","guid":{"rendered":"http:\/\/limitations.ca\/?p=759"},"modified":"2018-06-04T17:33:16","modified_gmt":"2018-06-04T21:33:16","slug":"ontario-the-discovery-provisions-apply-to-contribution-and-indemnity-claims","status":"publish","type":"post","link":"http:\/\/limitations.ca\/?p=759","title":{"rendered":"Ontario: the discovery provisions apply to contribution and indemnity claims"},"content":{"rendered":"<p>In <a href=\"http:\/\/canlii.ca\/t\/hrvbs\" target=\"_blank\"><em>Mega International Commercial Bank (Canada) v. Yung<\/em><\/a>, the Court of Appeal held that the discovery provisions of the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24\" target=\"_blank\">Limitations Act<\/a> determine the commencement of the limitation period for contribution and indemnity claims.\u00a0 This is an excellent, sensible decision that resolves one of the last significant (and somewhat inexplicable) uncertainties about the Ontario limitations scheme.<\/p>\n<p>A refresher: <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24?search=e+laws#BK5\">Section 4<\/a> provides the basic two-year limitation period that commences on when the plaintiff discovers the claim.\u00a0 <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24?search=e+laws#BK6\" target=\"_blank\">Section 5(1)<\/a> defines when discovery occurs.\u00a0 Section 5(2) provides a rebuttable presumption that it occurs on the date of the act or omission that gives rise to the claim.\u00a0 <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24?search=e+laws#BK16\" target=\"_blank\">Section 15<\/a> provides that the ultimate 15-year limitation period commences on the date of that act or omission.\u00a0 \u00a0<a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24?search=e+laws#BK21\" target=\"_blank\">Section 18<\/a> provides that for the purposes of s. 5(2) and s. 15, the date when a plaintiff serves a statement of claim on a defendant is the date of the act omission that gives rise to the defendant&#8217;s contribution and indemnity claim against another alleged wrongdoer.<\/p>\n<p>There were two competing constructions of s. 18.\u00a0 One line of jurisprudence originating from <a href=\"http:\/\/limitations.ca\/?p=257\" target=\"_blank\"><em>Miaskowski (Litigation Guardian of) v. Persaud<\/em><\/a>\u00a0held that s. 18 prescribes an absolute two-year limitation period that commences always on the date of service of the statement of claim.\u00a0 Another line of jurisprudence originating from <a href=\"http:\/\/limitations.ca\/?p=257\" target=\"_blank\"><em>Demide v. Attorney General of Canada et al.<\/em><\/a>\u00a0\u00a0held that s. 18 merely identifies the presumptive trigger date for the limitation period for contribution and indemnity claims, subject to the s. 5 discovery provisions.<\/p>\n<p><a href=\"http:\/\/limitations.ca\/?p=637\" target=\"_blank\">I&#8217;ve long argued <\/a>that <em>Miakowski <\/em>was plainly wrong, and its continued application was hard to understand. \u00a0<a href=\"http:\/\/limitations.ca\/?p=748\" target=\"_blank\">I noted with some satisfaction<\/a>\u00a0the trend toward preferring the\u00a0<em>Demide <\/em>construction.<\/p>\n<p>The Court in <em>Mega International <\/em>essentially adopted the reasoning in <em>Demide<\/em>.\u00a0 It applied the principles of statutory interpretation: the words in s .18 interpreted in their grammatical and ordinary sense do not establish an absolute limitation period.\u00a0 Rather, s. 18 works &#8220;hand in glove&#8221; with the provisions of s. 5(2) and s. 15 to identify the presumptive limitation period that applies in contribution and indemnity claims.\u00a0 It is not an exception to the basic limitation period in s. 4, but part of the integrated scheme established by s. 4 and s. 5.<\/p>\n<p>The Court acknowledged the injustice in constructing s. 18 as imposing an absolute limitation period.\u00a0 It would allow for the possibility of claims becoming statute-barred before they are discoverable.\u00a0 The Court also noted the absence of any basis for recalibrating the balance between plaintiff and defendant rights the Act strikes for this particular category of claims only.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Mega International Commercial Bank (Canada) v.
