Stan Fergusson Fuels Ltd.<\/em><\/a>, the Court of Appeal left open the possibility that <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24#BK24\" target=\"_blank\">s. 21 of the Limitations Act<\/a> might be broad enough to include mistake as to identity rather than merely a misdescription:<\/p>\n<blockquote><p>[112]\u00a0\u00a0\u00a0In my view, while the test for misnomer may be broad enough to embrace a mistake as to the identity of the person who should have brought a suit (rather than a misdescription of the person suing),<a href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2018\/2018onca192\/2018onca192.html?autocompleteStr=2018%20ONCA%20192&amp;autocompletePos=1#_ftn8\" name=\"_ftnref8\">[8]<\/a>\u00a0it cannot do so in this case. This is because, as I have explained above, at the time State Farm chose to commence a claim, it did not have capacity to do so in its own name.
