Solstice Two Limited<\/em><\/a>, the Court of Appeal reminds us that an application to recover monies advanced in a real estate purchase is subject to the <a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\" target=\"_blank\"><em>Real Property Limitations Act<\/em><\/a>:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\">[<a class=\"paragAnchor\" name=\"par25\"><\/a>25]\u00a0\u00a0 \u00a0\u00a0\u00a0Although the application judge should have responded overtly in her decision to Solstice\u2019s limitation period defence, she was clearly correct to reject it. In my view,\u00a0<em>Yim v. Talon International Inc.<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2017\/2017onca267\/2017onca267.html\"><span class=\"reflex3-alt\">2017 ONCA 267<\/span>\u00a0(CanLII)<\/a>,\u00a0<span class=\"reflex3-alt\">137 O.R. (3d) 184<\/span><\/span>\u00a0confirms that Ms. Scicluna\u2019s claim is governed by the 10 year limitation period in\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html#sec4_smooth\">s. 4<\/a>\u00a0of the\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\"><em>Real Property Limitations Act<\/em>, R.S.O. 1990, c. L.15<\/a>(\u201c<em><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\">RPLA<\/a><\/em>\u201d), not by the\u00a0<em>Limitations Act<\/em>. I reject Solstice\u2019s attempt to distinguish this case based on the factual difference that\u00a0<em>Yim\u00a0<\/em>dealt with a deposit whereas the \u201cforfeited money\u201d claimed by Solstice is no longer a deposit. The\u00a0<em>RPLA\u00a0<\/em>governs actions to recover \u201cland\u201d, and \u201cland\u201d is defined in s. 1 as including \u201cmoney to be laid out in the purchase of land\u201d. Ms. Scicluna\u2019s application to recover monies advanced in a real estate purchase falls under that definition regardless of whether it is properly characterized as a deposit.al<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>In Scicluna v.
