{"id":732,"date":"2018-03-15T13:41:43","date_gmt":"2018-03-15T17:41:43","guid":{"rendered":"http:\/\/limitations.ca\/?p=732"},"modified":"2018-03-15T13:41:43","modified_gmt":"2018-03-15T17:41:43","slug":"federal-where-does-a-cause-of-action-arise","status":"publish","type":"post","link":"http:\/\/limitations.ca\/?p=732","title":{"rendered":"Federal: Where does a cause of action arise?"},"content":{"rendered":"<p>The limitation period in <a href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/rsc-1985-c-f-7\/latest\/rsc-1985-c-f-7.html#sec39subsec2_smooth\" target=\"_blank\">s. 39(2)<\/a> of the <a href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/rsc-1985-c-f-7\/latest\/rsc-1985-c-f-7.html#sec39subsec2_smooth\"><em>Federal Courts Act<\/em><\/a> applies when a cause of action arises otherwise than in a province:<\/p>\n<blockquote><p><span class=\"lawlabel\"><span class=\"canlii_subsection\">(2)<\/span><\/span>\u00a0A proceeding in the Federal Court of Appeal or the Federal Court in respect of a cause of action arising otherwise than in a province shall be taken within six years after the cause of action arose.<\/p><\/blockquote>\n<p>When does a cause of action arise in a province? The Federal Court of Appeal&#8217;s decision in <a href=\"http:\/\/canlii.ca\/t\/hqjv2\" target=\"_blank\"><em>Canada (Attorney General) v. Liang<\/em><\/a> clarifies:<\/p>\n<blockquote>\n<p class=\"ParagNum\">[<a class=\"paragAnchor\" name=\"par19\"><\/a>19]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0A cause of action is a set of facts that provides the basis for an action in court: see\u00a0<i>Markevich<\/i>, at paragraph\u00a027.\u00a0A cause of action arises in a province when all of the elements of the cause of action are present in that province: see\u00a0<i>Canada v. Canada Maritime Group (Canada) Inc.<\/i>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/fca\/doc\/1995\/1995canlii3513\/1995canlii3513.html\">1995 CanLII 3513 (FCA)<\/a>,\u00a0<span class=\"reflex3-alt\">[1995] 3 F.C.\u00a0124<\/span>\u00a0at page 129,\u00a0<span class=\"reflex3-alt\">185\u00a0N.R.\u00a0104<\/span><\/span>;\u00a0<i>Apotex v. Sanofi-Aventis<\/i>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/fca\/doc\/2013\/2013fca186\/2013fca186.html\"><span class=\"reflex3-alt\">2013 FCA\u00a0186<\/span>\u00a0(CanLII)<\/a>\u00a0at paragraph\u00a0105,\u00a0<\/span><span class=\"reflex3-alt\">[2015] 2 F.C.R.\u00a0644<\/span>. The question as to which facts constitute the plaintiffs\u2019 cause of action and where they arose does not appear to have been canvassed in the Federal Court and it was not debated on this appeal.
