The decision in <a href=\"http:\/\/canlii.ca\/t\/hppfr\" target=\"_blank\"><em>Golberg v. North East Community Care Access Centre <\/em><\/a>reminds us that it&#8217;s extended until Monday:<\/p>\n<blockquote>\n<p class=\"MainParagraph\">[<a class=\"paragAnchor\" name=\"par12\"><\/a>12]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Bayshore first argues that the Plaintiff\u2019s claims fall outside the two year limitations period prescribed by the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a>.<\/i>\u00a0\u00a0In particular, it points out that Mr. Golberg admits to having been dismissed from his employment on March 20, 2014, but that his action was started on March 21, 2016.<\/p>\n<p class=\"MainParagraph\">[<a class=\"paragAnchor\" name=\"par13\"><\/a>13]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0What Bayshore has failed to realize is that March 20, 2016 was a Sunday.\u00a0 Under the\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2006-c-21-sch-f\/latest\/so-2006-c-21-sch-f.html#sec89subsec1_smooth\"><i>Legislation Act, 2006<\/i>, section 89(1)<\/a>\u00a0provides that a limitation that expires on a holiday is extended to the following day.\u00a0 Accordingly, Mr. Golberg started this action within the appropriate time.<\/p>\n<\/blockquote>\n<p>Nice try, defendants.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>What happens if the limitation period expires on a Sunday?
