{"id":584,"date":"2017-06-25T17:17:36","date_gmt":"2017-06-25T21:17:36","guid":{"rendered":"http:\/\/limitations.ca\/?p=584"},"modified":"2017-06-25T17:17:36","modified_gmt":"2017-06-25T21:17:36","slug":"ontario-the-trustee-act-limitation-period-trumps-s-18-of-the-limitations-act","status":"publish","type":"post","link":"http:\/\/limitations.ca\/?p=584","title":{"rendered":"Ontario: the Trustee Act limitation period trumps s. 18 of the Limitations Act"},"content":{"rendered":"<p>The Court of Appeal has held that when one joint tortfeasor has died and the other makes a crossclaim for indemnity against her estate, <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90t23#BK49\" target=\"_blank\">s. 38(3)<\/a> of the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90t23\" target=\"_blank\">Trustee Act<\/a> limits the claim, not the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/02l24#BK21\" target=\"_blank\">Limitations Act&#8217;s s. 18<\/a> contribution and indemnity provision.<\/p>\n<p>Justice Strathy&#8217;s decision in <em><a href=\"http:\/\/canlii.ca\/t\/h43cq\" target=\"_blank\">Levesque v. Crampton Estate<\/a><\/em> is well-reasoned, and I think, correct.<\/p>\n<p>Unfortunately, it missed an opportunity to resolve a limitations issue of more widespread application: whether the s. 5 discovery provisions apply to s. 18. \u00a0 \u00a0In <a href=\"http:\/\/canlii.ca\/t\/ggndd\" target=\"_blank\"><em>Miaskowski v. Persaud<\/em><\/a>, the court\u00a0concluded that s.\u00a018 is a self-contained deeming provision that imposes an absolute two-year limitation period for claims for contribution and indemnity. \u00a0The court&#8217;s\u00a0analysis turns on the word &#8220;deemed&#8221; in s.\u00a018, which, &#8220;as a declarative legal concept is a firmer or more certain assertion of the discovery of a claim than the rebuttable presumption of discovery contemplated by section 5&#8221;.<\/p>\n<p>The problem with this analysis is that it fails to consider that s.\u00a018 was expressly enacted &#8220;For the purposes of subsection 5(2) and section 15&#8221;, that is, to inform and dictate the meaning to be given to the concepts referred to in those sections when applying them.<\/p>\n<p>This is the point made in detail by Justice Leach in <em><a href=\"http:\/\/canlii.ca\/t\/gj40v\" target=\"_blank\">Demide v. Attorney General of Canada et al.<\/a>\u00a0\u00a0<\/em>Justice Leach systematically analysed the flaws in <em>Miaskowski&#8217;s\u00a0<\/em>reasoning.\u00a0\u00a0 She concluded that the purpose of s.\u00a018 is to provide when time begins to run for the basic and ultimate limitation periods in claims for contribution and indemnity.\u00a0 It deems the day of service of the statement of claim giving rise to the claim for contribution and indemnity to be the commencement of the ultimate limitation period and the presumptive commencement of the basic limitation period.<\/p>\n<p>The language Justice Strathy uses could support either construction.\u00a0 He writes\u00a0 that s. 18 &#8220;provides that a claim for contribution and indemnity is &#8216;discovered&#8217; and, therefore, the limitation period begin to run, on the day on which the wrongdoer seeking indemnity is served with the plaintiff&#8217;s claim.&#8221;\u00a0 Does this mean the limitation period begins to run presumptively, or begins to run in all circumstances?<\/p>\n<p>Paragraph 17 tends to suggest that it runs in all circumstances:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\">[<a class=\"paragAnchor\" name=\"par17\"><\/a>17]\u00a0\u00a0 \u00a0\u00a0 Thus, the general two-year limitation period runs from the date that the party claiming contribution and indemnity is served with the claim in respect of which contribution is sought.<\/p>\n<\/blockquote>\n<p>My hope is that when\u00a0the Court of Appeal directly considers the matter,\u00a0Justice Leach&#8217;s analysis will prevail. \u00a0<em>Miaskowksi\u00a0<\/em>is at odds with a common sense reading of the Limitations Act as a whole, and introduces unnecessary and unhelpful complexity into the limitations scheme.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Court of Appeal has held that when one joint tortfeasor has died and the other makes a crossclaim for indemnity against her estate, s. 38(3) of the Trustee Act limits the claim, not the Limitations Act&#8217;s s. 18 contribution and indemnity provision.
