James<\/em><\/a>, the parties disagreed on whether the\u00a0<a href=\"http:\/\/canlii.ca\/t\/31q\" target=\"_blank\">Limitations Act<\/a>\u00a0applies to oppression claims brought under the <a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-c26\/latest\/rso-1990-c-c26.html\" target=\"_blank\"><em>Condominium Act <\/em><\/a>and the <a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-b16\/latest\/rso-1990-c-b16.html\" target=\"_blank\"><em>Ontario Business Corporations Act<\/em><\/a>.\u00a0 The Court declined to resolve the issue.<\/p>\n<p>I agree with the plaintiff, who argued, in the Court&#8217;s words, &#8220;that there is a clear jurisprudential consensus that the two year limitation period applies&#8221;.\u00a0 I see no viable argument otherwise.\u00a0 The Limitations Act applies to all claims pursued in court proceedings.\u00a0 Whether the claim is statutory is of no relevance.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In McFlow Capital Corp. v.
