St. Marys (Town) <\/em><\/a>is one of the few cases that\u00a0involve\u00a0the limitation period in section 273(5) of the <a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2001-c-25\/latest\/so-2001-c-25.html\" target=\"_blank\">Municipal Act<\/a>:<\/p>\n<blockquote><p>[28]\u00a0\u00a0 \u00a0\u00a0 To summarize, a party may commence proceedings to quash a bylaw under <a class=\"reflex2-link\" href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2001-c-25\/latest\/so-2001-c-25.html#sec273_smooth\">s. 273<\/a> of the\u00a0<em><a class=\"reflex2-link\" href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2001-c-25\/latest\/so-2001-c-25.html\">Municipal Act, 2001<\/a><\/em> by way of application. Such a proceeding is captured by the statutory one year limitation period. Alternatively, a party may commence an application or an action for declaratory relief. Such a proceeding is distinct from the statutory remedy of quashing a bylaw under <a class=\"reflex2-link\" href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2001-c-25\/latest\/so-2001-c-25.html#sec273_smooth\">s. 273<\/a>, and as such, is not captured by the one year limitation period.<\/p><\/blockquote>\n<p>This is not particularly\u00a0revelatory\u00a0stuff, but\u00a0it&#8217;s unusual enough issue to be of note.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Court of Appeal&#8217;s decision in Foley v.
