{"id":325,"date":"2015-10-24T11:49:40","date_gmt":"2015-10-24T15:49:40","guid":{"rendered":"http:\/\/limitations.ca\/?p=325"},"modified":"2015-10-24T11:51:04","modified_gmt":"2015-10-24T15:51:04","slug":"ontario-the-limitation-of-mortgage-enforcement","status":"publish","type":"post","link":"http:\/\/limitations.ca\/?p=325","title":{"rendered":"Ontario: the limitation of mortgage enforcement"},"content":{"rendered":"<p>Curiously, posts about the <em><a href=\"http:\/\/canlii.ca\/t\/kpn0\" target=\"_blank\">Real Property Limitations Act<\/a><\/em> receive the most views on <em>Under the Limit<\/em>.\u00a0 My guess is that this reflects the murkiness of the Act more than people&#8217;s interest in it.\u00a0 The Act is Part I of <a href=\"http:\/\/www.ontario.ca\/laws\/statute\/90l15\/v1\" target=\"_blank\">the former Limitations Act<\/a>, renamed, but otherwise unchanged from its antiquated and impermeable glory. \u00a0When the Ontario limitations regime was being reformed, a\u00a0complete review of limitations was too time-consuming, and so review of the real property limitation periods was abandoned to avoid delaying the other reforms.\u00a0 Should you be interested, the legislative history is detailed <a href=\"http:\/\/canlii.ca\/t\/1qbn2\" target=\"_blank\">here <\/a>at\u00a0paragraphs 27-33.<\/p>\n<p>In the spirit of catering to my market, I present the decision in <em><a href=\"http:\/\/canlii.ca\/t\/glgmh\" target=\"_blank\">552439 Ontario Limited v. Forbes Building Material Limited<\/a><\/em> for its summary of the section 23(1) limitation period for mortgage enforcement:<\/p>\n<blockquote><p><em><u><a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\">Real Property Limitations Act<\/a><\/u><\/em><\/p>\n<p>\u2212\u00a0\u00a0 \u00a0\u00a0 \u00a0 <a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html#sec23subsec1_smooth\">Paragraph 23(1)<\/a> of the <em><a href=\"http:\/\/www.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-l15\/latest\/rso-1990-c-l15.html\">Real Property Limitations Act<\/a><\/em> provides for a ten-year limitation period for the enforcement of a mortgage.\u00a0 It reads as follows:<\/p>\n<p>&nbsp;<\/p>\n<p>23(1)\u00a0 \u201c4.\u00a0 No action shall be brought to recover out of any land or rent any sum of money secured by any mortgage or lien, or otherwise charged upon or payable out of the land or rent, or to recover any legacy, whether it is or is not charged upon land, but within ten years next after a present right to receive it accrued to some person capable of giving a discharge for, or release of it, unless in the meantime some part of the principal money or some interest thereon has been paid, or some acknowledgment in writing of the right thereto signed by the person by whom it is payable, or the person\u2019s agent, has been given to the person entitled thereto or that person\u2019s agent, and in such case no action shall be brought but within ten years after the payment or acknowledgment, or the last of the payments or acknowledgments if more than one, was made or given.\u201d<\/p>\n<p>\u2212\u00a0\u00a0 \u00a0\u00a0 \u00a0 It is the nature of the mortgage which will determine when the ten-year period is triggered.\u00a0 The limitation cannot pass before the mortgagee has any right to enforce.\u00a0 The limitation runs from the earliest time at which repayment can be required.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2212\u00a0\u00a0 \u00a0\u00a0 \u00a0 While there are exceptions, on a demand mortgage, the cause of action accrues upon execution of the mortgage.<\/p>\n<p>&nbsp;<\/p>\n<p>&#8211;\u00a0 Mortgage Insurance Co. of Canada v. Grant <a href=\"http:\/\/www.canlii.org\/en\/on\/onca\/doc\/2009\/2009onca655\/2009onca655.html\">2009 ONCA 655 (CanLII)<\/a>, [2009] O.J. No. 3769<\/p>\n<p>&#8211;\u00a0 Alter v. Csontos <span data-path=\"\/en\/reflex\/747899.html\">[2004] O.J. No. 1590<\/span><\/p>\n<p>&#8211;\u00a0 Cioccio v. Cioccio <span data-path=\"\/en\/reflex\/1045843.html\">[2005] O.J. No. 1182<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>\u2212\u00a0\u00a0 \u00a0\u00a0 \u00a0 If the terms of the mortgage provide for payment upon the happening of a specific contingency, then the cause of action arises upon the happening of the contingency.\u00a0 Thus, the ten-year statutory limitation does not run until the contingency is satisfied.<\/p>\n<p>&nbsp;<\/p>\n<p>&#8211;\u00a0 Re Gould Ex Parte Garvey <a href=\"http:\/\/www.canlii.org\/en\/on\/onca\/doc\/1940\/1940canlii89\/1940canlii89.html\">1940 CanLII 89 (ON CA)<\/a>, [1940] O.R. 250 (Ont.
