{"id":164,"date":"2015-02-23T16:06:44","date_gmt":"2015-02-23T20:06:44","guid":{"rendered":"http:\/\/limitations.ca\/?p=164"},"modified":"2015-02-23T19:54:18","modified_gmt":"2015-02-23T23:54:18","slug":"ontario-ten-years-later-to-some-the-new-limitations-regime-still-feels-new","status":"publish","type":"post","link":"http:\/\/limitations.ca\/?p=164","title":{"rendered":"Ontario: Ten years later, to some the &#8220;new&#8221; limitations regime is still new"},"content":{"rendered":"<p>Nearly two months into 2015, there\u2019s only a trickle of new limitations jurisprudence, and so today we offer a practice tip.<\/p>\n<p>As <em>Under The Limit Readers <\/em>know, 2014 marked ten years since the <a href=\"http:\/\/www.e-laws.gov.on.ca\/html\/statutes\/english\/elaws_statutes_02l24_e.htm\" target=\"_blank\"><em>Limitations Act, 2002 <\/em><\/a>came into force. You\u2019d think that over the course of the last decade, bench and bar would have become accustomed to the new limitations regime, and it would have stopped feeling quite so new.<\/p>\n<p>This is the case, mostly. We still see <a href=\"http:\/\/limitations.ca\/?p=80\" target=\"_blank\">decisions that revert to the old limitations regime<\/a> or, as in the recent decision in <a href=\"http:\/\/canlii.ca\/t\/gg32w\" target=\"_blank\"><em>Bartholomew v. Coco Paving and LeFarge<\/em><\/a>, inform us that \u201cA new <em>Limitations<\/em><em> Act <\/em>was passed in 2002\u201d as if we were out-of-province and off-grid for the last 15 years.<\/p>\n<p>These decisions are a reminder that for some, the <em>Limitations Act<\/em> remains a novelty.
