Trillium Gift of Life Network et al.<\/em><\/a>, the Superior Court held that an action seeking a declaration that <em>Charter <\/em>rights have been infringed could shelter within s. 16(1)(a) because it seeks no consequential relief:<\/p>\n<div class=\"paragWrapper\">\n<blockquote>\n<p class=\"MainParagraph\" data-viibes-parag=\"69\" data-viibes-start=\"68\" data-viibes-end=\"67\">[<a class=\"reflex-paragAnchor\" name=\"par69\"><\/a>69]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0The respondents argue that the relief sought relating to the death of Mr. Selkirk is statute barred. Mr. Selkirk died in 2010 and this application was commenced in 2015. They argue that a two-year limitation period applies to personal relief sought under\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html#sec24subsec1_smooth\">s. 24(1)<\/a>\u00a0of the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Charter<\/a><\/i>.<\/p>\n<\/blockquote>\n<\/div>\n<blockquote>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"70\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"70\" data-viibes-start=\"69\" data-viibes-end=\"68\">[<a class=\"reflex-paragAnchor\" name=\"par70\"><\/a>70]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0In\u00a0<i>Ravndahl v. Saskatchewan<\/i>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/2009\/2009scc7\/2009scc7.html\">2009 SCC 7<\/a>, [2009] 1 S.C.R. 181, the court distinguished between the litigant\u2019s personal remedies, brought by her as an individual, from an\u00a0<i>in rem<\/i>\u00a0remedy flowing from\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html#sec52_smooth\">s. 52<\/a>\u00a0of the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Constitution Act, 1982<\/a><\/i>. In that case, the appellant\u2019s personal claim was statute barred, but her claim for a declaration of invalidity arising out of\u00a0<span class=\"reflex2-link\" data-link-type=\"weak\">s. 52<\/span>\u00a0was allowed to proceed.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"71\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"71\" data-viibes-start=\"70\" data-viibes-end=\"69\">[<a class=\"reflex-paragAnchor\" name=\"par71\"><\/a>71]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0In\u00a0<i>Alexis v. Darnley<\/i>, 2009 ONCA 847,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2009\/2009onca847\/2009onca847.html\">100 O.R. (3d) 232<\/a>, the Court of Appeal held that limitation periods of general application apply to an action brought by an individual for a personal remedy under\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html#sec24subsec1_smooth\">s. 24(1)<\/a>\u00a0of the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Charter<\/a><\/i>. Pursuant to the\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\"><i>Limitations Act, 2002<\/i>, S.O. 2002, c. 24, Sch. B<\/a>, the relevant limitation period is two years:\u00a0<i>Alexis<\/i>, at para.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2009\/2009onca847\/2009onca847.html#par21\">21<\/a>.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"72\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"72\" data-viibes-start=\"71\" data-viibes-end=\"70\">[<a class=\"reflex-paragAnchor\" name=\"par72\"><\/a>72]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Ms. Selkirk argues that the relief sought is not out of time. She relies on\u00a0<a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec16subsec1_smooth\">s. 16(1)<\/a>(a) of the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act, 2002<\/a><\/i>, which provides that there is no limitation period in respect of a proceeding for a declaration if no consequential relief is sought. She argues that she seeks a simple declaration that Mr. Selkirk\u2019s rights were infringed, which does not pronounce any sanction against the respondents. She seeks no consequential relief.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"73\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"73\" data-viibes-start=\"72\" data-viibes-end=\"71\">[<a class=\"reflex-paragAnchor\" name=\"par73\"><\/a>73]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0In determining whether the relief sought is purely declaratory, the court asks the question: if it granted the declaration, and the defendant resisted the implementation of the declaration, could the plaintiff leave the court in peace and enjoy the benefits of the declaration without further resort to the judicial process?:\u00a0<i>Skylark Holdings Limited v. Minhas<\/i>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2017\/2017onsc4599\/2017onsc4599.html\">2017 ONSC 4599<\/a>, at paras.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2017\/2017onsc4599\/2017onsc4599.html#par26\">26<\/a>, 28-29,\u00a0<i>Yellowbird v. Samson Cree Nation No. 444<\/i>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ab\/abca\/doc\/2008\/2008abca270\/2008abca270.html\">2008 ABCA 270<\/a>, 433 A.R. 350, at paras.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/ab\/abca\/doc\/2008\/2008abca270\/2008abca270.html#par45\">45-47<\/a>.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"74\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"74\" data-viibes-start=\"73\" data-viibes-end=\"72\">[<a class=\"reflex-paragAnchor\" name=\"par74\"><\/a>74]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0I agree with Ms. Selkirk that the personal remedies sought with respect to Mr. Selkirk\u2019s rights are declaratory only. If the declaratory relief is granted, Ms. Selkirk could leave the court in peace and enjoy the benefits of the declaration without further resort to the judicial process.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"75\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"75\" data-viibes-start=\"74\" data-viibes-end=\"73\">[<a class=\"reflex-paragAnchor\" name=\"par75\"><\/a>75]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0This is because the declaration sought would, if granted, serve the purpose of vindicating Mr. Selkirk\u2019s\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Charter<\/a>\u00a0<\/i>rights, and recognize that public confidence in the\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Charter<\/a>\u00a0<\/i>may be negatively impacted when state actors violate\u00a0<i><a class=\"reflex2-link\" href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html\">Charter<\/a>\u00a0<\/i>rights, especially if doing so results in death. On its own, the vindication, if warranted, would have value.<\/p>\n<\/div>\n<div class=\"paragWrapper\">\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"76\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"76\" data-viibes-start=\"75\" data-viibes-end=\"74\">[<a class=\"reflex-paragAnchor\" name=\"par76\"><\/a>76]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Ms. Selkirk makes no claim for monetary compensation or any other consequential relief. If the declaratory relief is granted, the court\u2019s role is complete.<\/p>\n<\/div>\n<\/blockquote>\n<div class=\"paragWrapper\">\n<blockquote>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\" data-with-parag=\"77\"><\/div>\n<p class=\"MainParagraph\" data-viibes-parag=\"77\" data-viibes-start=\"76\" data-viibes-end=\"75\">[<a class=\"reflex-paragAnchor\" name=\"par77\"><\/a>77]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0I thus find that these claims are not statute-barred.<\/p>\n<\/blockquote>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>In Selkirk et al. v.
