Ontario<\/i>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2015\/2015onca147\/2015onca147.html\"><span class=\"reflex3-alt\">2015 ONCA 147<\/span><\/a>, at paras.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2015\/2015onca147\/2015onca147.html#par2\">2-3<\/a><\/span>;\u00a0<i>Fantl v. (5th) 175<\/span>, at paras.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2013\/2013onsc2298\/2013onsc2298.html#par180\">180-181<\/a><\/span>, varied on other grounds,\u00a0<span class=\"reflex3-block\"><span class=\"reflex3-alt\">2015 ONSC 1367<\/span>,\u00a0<span class=\"reflex3-alt\">125 O.R. (3d) 230 (Div. Ct.)<\/span>,\u00a0<span class=\"reflex3-alt\">2016 ONCA 633<\/span>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2016\/2016onca633\/2016onca633.html\"><span class=\"reflex3-alt\">133 O.R. (3d) 422<\/span><\/a><\/span>. Even if the cargo claim does not involve a discoverability analysis as contended by Anderson Haulage, the negligence and contract claims that have been pleaded do give rise to an assessment of discoverability.<\/p><\/blockquote>\n<p>To my knowledge, that principle isn&#8217;t stated elsewhere so succinctly.
