Canada (Attorney General)<\/a><\/em>, the Court of Appeal held that a\u00a0claim for damages arising from the adoption and maintenance of a federal regulatory policy regime that applies in all provinces arises \u201cotherwise than in a province\u201d and is therefore subject to the limitation period in s. 32 the <em>Crown Liability and Proceedings Act<\/em>.\u00a0 Federal limitation principles apply to that limitation period:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\" data-viibes-end=\"30\" data-viibes-parag=\"32\" data-viibes-start=\"31\" data-noteup-count=\"0\">[32]\u00a0\u00a0 \u00a0\u00a0\u00a0We agree with the motion judge that the six-year federal limitation period applies to these claims. The claims for\u00a0<em>Charter<\/em>\u00a0damages in both cases are with respect to the adoption and maintenance of a federal regulatory policy regime regarding administrative segregation that applied in all provinces. In this sense, the claims for\u00a0<em>Charter<\/em>\u00a0damages arise \u201cotherwise than in a province\u201d: see\u00a0<em>Markevich v. Canada<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/2003\/2003scc9\/2003scc9.html\"><span class=\"reflex3-alt\">2003 SCC 9<\/span><\/a>,\u00a0<span class=\"reflex3-alt\">[2003] 1 S.C.R. 94<\/span><\/span><em>.<\/em>\u00a0As found by the motion judge, the start date for claims in\u00a0<em>Brazeau<\/em><em>\u00a0<\/em>is July 20, 2009, and in\u00a0<em>Reddock<\/em>, it is March 3, 2011.<\/p>\n<p class=\"AParaNumbering\" data-viibes-end=\"30\" data-viibes-parag=\"32\" data-viibes-start=\"31\" data-noteup-count=\"0\">[33]\u00a0\u00a0 \u00a0\u00a0\u00a0We do not, however, agree with how the motion judge dealt with the potential tolling of the limitation period for particular individuals. At para. 386 of<em>\u00a0Brazeau<\/em>, the motion judge said it was open to individual claimants to rebut the running of \u201cthe six-year limitation period in accordance with the laws relating to prescription and the limitation of actions in force in a province\u201d. If the federal limitation period applies, we do not understand how the tolling of that limitation period could be determined by provincial law. The\u00a0<em>Charter<\/em>\u00a0claims in both cases are governed by the federal limitation period and the jurisprudence relating to the tolling of that limitation period: see e.g.,\u00a0<em>Doig v. Canada (Minister of National Revenue)<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/fct\/doc\/2011\/2011fc371\/2011fc371.html\"><span class=\"reflex3-alt\">2011 FC 371<\/span><\/a>,\u00a0<span class=\"reflex3-alt\">387 F.T.R. 156<\/span><\/span>.<\/p>\n<\/blockquote>\n<p>I confess that it\u2019s not clear to me how s. 32 the <em>Crown Liability and Proceedings Act <\/em>can oust the application of the Limitations Act.\u00a0 Claims against the Crown are not excluded from limitation in s. 2, and the CLPA limitation period isn\u2019t in the Limitation Act\u2019s s. 19 schedule of limitation periods that remain in force. I\u2019ve never seen this conflict explained, though to be fair I haven\u2019t read into it too deeply.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In\u00a0Brazeau v.
