Dundee Kilmer Developments Limited Partnership<\/em><\/a>\u00a0follows <a href=\"http:\/\/limitations.ca\/?p=966\" target=\"_blank\"><em>Klassen <\/em><\/a>for its statement on adding a claim after the expiry of the limitation period:<\/p>\n<blockquote>\n<p class=\"AParaNumbering\" data-viibes-end=\"73\" data-viibes-parag=\"75\" data-viibes-start=\"74\" data-noteup-count=\"0\">[<a class=\"reflex-paragAnchor\" name=\"par75\"><\/a>75]\u00a0\u00a0 \u00a0\u00a0\u00a0I accept this submission. The governing principles were stated by this court in\u00a0<em>Klassen v. Beausoleil<\/em>,\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2019\/2019onca407\/2019onca407.html\"><span class=\"reflex3-alt\">2019 ONCA 407<\/span><\/a>,\u00a0<span class=\"reflex3-alt\">34 C.P.C. (8th) 180<\/span>, at paras.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2019\/2019onca407\/2019onca407.html#par27\">27-30<\/a><\/span>:<\/p>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\">\u00a0An amendment [to a statement of claim] will be statute-barred if it seeks to assert a \u201cnew cause of action\u201d after the expiry of the applicable limitation period:\u00a0<em>North Elgin<\/em>, at paras. 19-23, 33;\u00a0<em>Quality Meat Packers<\/em>, at para. 65. In this regard, the case law discloses a \u201cfactually oriented\u201d approach to the concept of a \u201ccause of action\u201d \u2014 namely, \u201ca factual situation the existence of which entitles one person to obtain from the court a remedy against another person\u201d:\u00a0<em>North Elgin<\/em>, at para. 19;\u00a0<em>Quality Meat Packers<\/em>, at para. 65.<\/div>\n<p class=\"CQuote\">An amendment does not assert a new cause of action \u2014 and therefore is not impermissibly statute-barred \u2014 if the \u201coriginal pleading &#8230; contains all the facts necessary to support the amendments &#8230; [such that] the amendments simply claim additional forms of relief, or clarify the relief sought, based on the same facts as originally pleaded\u201d:\u00a0<em>Dee Ferraro<\/em>, at paras. 4, 13-14;\u00a0<em>North Elgin Centre Inc.<\/em>, at paras. 20-21;\u00a0<em>East Side Mario&#8217;s Barrie<\/em>, at paras. 31-32;\u00a0<em>Quality Meat Packers<\/em>, at para. 65. Put somewhat differently, an amendment will be refused when it seeks to advance, after the expiry of a limitation period, a \u201cfundamentally different claim\u201d based on facts not originally pleaded:\u00a0<em>North Elgin<\/em>, at para. 23.<\/p>\n<p class=\"CQuote\">The relevant principle is summarized in Paul M. Perell &amp; John W. Morden,\u00a0<em>The Law of Civil Procedure in Ontario<\/em>, 3rd ed. (Toronto: LexisNexis, 2017), at p. 186:<\/p>\n<p class=\"DSubquote\">A new cause of action is not asserted if the amendment pleads an alternative claim for relief out of the same facts previously pleaded and no new facts are relied upon, or amount simply to different legal conclusions drawn from the same set of facts, or simply provide particulars of an allegation already pled or additional facts upon [which] the original right of action is based.<\/p>\n<p class=\"CQuote\">In the course of this exercise, it is important to bear in mind the general principle that, on this type of pleadings motion, it is necessary to read the original Statement of Claim generously and with some allowance for drafting deficiencies:\u00a0<em>Farmers Oil and Gas Inc. v. Ontario (Ministry of Natural Resources)<\/em>,\u00a0<span class=\"reflex3-block\"><span class=\"reflex3-alt\">2016 ONSC 6359<\/span>,\u00a0<a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/on\/onscdc\/doc\/2016\/2016onsc6359\/2016onsc6359.html\"><span class=\"reflex3-alt\">134 O.R. (3d) 390 (Div. Ct.)<\/span><\/a>, at para.\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/on\/onscdc\/doc\/2016\/2016onsc6359\/2016onsc6359.html#par23\">23<\/a><\/span>.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; The Court of Appeal decision in The Catalyst Capital Group Inc. v.
